Lynne Amidon vs the Tavistock and Portman NHS Trust
Lynne Amidon was a Consultant Child and Adolescent Psychotherapist and Team Manager working for the Tavistock and Portman NHS Trust (TPNHST). She qualified as a Child Psychotherapist in 1999 and has been working with abused and neglected children for the last 24 years.
Dr Amidon worked as part of the Complex Assessment Team (CAT) and is responsible to the Service Manager of the Camden CAMHS. Her role and the role of her team was to provide expert witness assessments and evidence to the Family Court when social services are involved in child care proceedings.
Dr Amidon brought a claim against the TPNHST in the Central London Employment Tribunal (CLET). The legal claim involved whistleblowing and discrimination. She asserted that she was subjected to detriments because of concerns to raised about child safeguarding.cShe has since been made redundant by the TPNHST.
Status
Dr Amidon’s claim was heard in the CLET in May & August 2024. The claim was unsuccessful on all grounds. The ET agreed that she had made protected disclosures but found that she had not suffered any detriments related to the protected disclosures. The judgement can be found here.
There has been a number of further legal proceedings in the case. These are dealt with the following paragraphs.
Application for Reconsideration - Dr Amidon applied to have her decision reconsidered. The application for reconsideration was refused; the judgment can be found here.
Appeal - the appeal was accepted by the Employment Appeal Tribunal (EAT) and will now be heard before an EAT judge. This is expected in winter 2025 although no date has been set.
Costs Application - Dr Amidon sought costs from the TPNHST despite losing her case subject to appeal. This is exceptional in first tier tribunals. The cost application was made on the basis of how and when a witness for the Trust gave evidence. The costs application was denied, see coverage below. The judgment will be added when available.
