Peggie vs NHS Scotland & Dr B Upton - Use of Live Text Based Communications
Respondents seek revocation of Tribunal Tweets permission to live tweet
NHS Fife and Dr B Upton are the respondents in the employment tribunal of Sandie Peggie. Tribunal Tweets sought and were granted permission to report on the proceedings using live text based communications. Our coverage of proceedings is found here. The case attracted a great deal of press attention, links to coverage can be found on the main substack page for articles through 17 February 2025 and here for articles subsequent to that date. The proceeding has gone part-heard and is expected to resume on 16 July 2025.
The respondents, who had initially opposed the Tribunal Tweets application to report, subsequently applied to have that permission revoked. The respondents cited errors in reporting and argued that Tribunal Tweets was biased in its coverage, through selective errors, omissions and paraphrasing. The respondents made no complaints to Tribunal Tweets or to the Tribunal during the hearing. Our reporting over the 10 days of evidence comprised thousands of tweets. The respondents submitted an analysis of individual tweets that they asserted contained errors or demonstrated bias. That analysis was based on the detailed notes and materials of the Respondents. There is no published transcript of proceedings.
The Employment Tribunal did not grant the respondents application and Tribunal Tweets expects to be reporting on the resumed hearing in July 2025. However, based on the respondents detailed analysis, our own recollection and other contemporaneous reports, we have prepared two corrections, as below.
We will post these corrections on our X account when proceedings resume on 16 July 2025 and encourage our audience to share them widely.
A reminder - our work is not a verbatim transcript of proceedings. We report in good faith and make all efforts to ensure our output is accurate and will continue to do so.
